Do the police have to inform me that I have the right to have my parents present before I am questioned?

No. Even though you have the right to have your parents present before questioning, the police do not have to inform you of that right. What rights do I have in juvenile court?

You have the right to have an attorney defend you at all stages of the proceedings and you have the right to have a trial. You have the right to confront and cross examine any witnesses who may be called against you. You have the right to issue subpoenas and have witnesses brought into court on your behalf. You have the right against self-incrimination which means you would not have to take the witness stand unless you choose to do so. While this is a non-jury trial, which means the judge is the one who determines guilty or innocence, you still have the right to be presumed innocent until and only if the state can prove your guilty beyond a reasonable doubt.


How long can a juvenile be in custody for?

A juvenile has the right to see a Judge within 24 hours of being arrested and can be detained by the Judge for up to 21 days on a normal arrest. There are some exceptions to this rule. If a juvenile is found guilty of a crime they may be sentenced to probation or a program. The length of a program depends on the charges and how well the juvenile does while at the program.
